Where do I stand with work? On Maternity leave, but company been taken over!!?

I have just started my Maternity leave before christmas, but haven't had the baby yet - due in 6days. I am not due to go back until Sept, but in April the company I work for are leaving and another Company will be taking over. I work for the council, but we are contracted out to companies - which is changed every 4/5years. Due to this, I have just been informed that the department i work for will no longer exist and only some staff will be transferred to another company and others will be without a job. Where does this leave me?

Will the new company have to fulfill my maternity leave until the Sept or will they terminate my contract and not pay me after april. I have been informed there are meetings been held next month where we will be interviewed and asked what our roles are - where they will decide if that position is still available.

My main concern is that they will not fulfill my Maternity leave and what I will then be entitled to - as I am currently a single parent and money is very hard as it is.

As Steve says, you should be covered by TUPE. Speak to your local CAB who are very good on this sort of thing. They'll help you ask the right questions to find out what your position is.

  • I believe all Council contracts are covered by TUPE .. if so, the new company must honor your Maternity Leave (however they CAN make you Redundant when your leave ends)

    Talk to your Union Rep. (if you are not in a Union, and are considering going back to work, perhaps you should join one).
