Who owns the right to a partnership name after it has dissolved?

I was in a business partnership, although there was no partnership agreement in writing. We ceased the partnership, and now my former partner is using our name in conjunction with their new business in the same field. Is this allowed? I was using the name before our partnership if this makes any difference.

whoever registered the name, thats who it belongs to. if you did it, you can seek legal advice on getting him to cease, if not, you snooze you lose
